Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website, applications, and services provided by Resumaier LLC (“Resumaier”, “we”, “us”). By using our services, you agree to these Terms.

1) Eligibility & Accounts

• You must be at least 16, able to form a binding contract, and use the Service in compliance with applicable laws.
• You are responsible for your account and for keeping your credentials secure.

2) Plans, Credits, and Throttles

We offer the following plan structure (see Pricing for details):

• Starter: $0.99 one-time; 3 credits usable within 7 days; balanced model.
• Job-Seeker (JS): $9.99/month; 50 credits/month; premium model.
• Job-Seeker+ (JS+): $19.99/month; 120 credits/month; premium model.
• Top-ups: $5 → 20 credits; available to all plans.

Credit usage: 1 alignment = processing one resume + one job description and viewing the full output. Side-by-side (both models) consumes 2 credits. A 2-hour grace window allows up to 5 regenerations of the same resume+JD without extra credits; switching to “Both” within the window deducts +1 credit.

Daily throttles: JS: 5 jobs/day; JS+: 20 jobs/day. Side-by-side counts as 1 job (but 2 credits).

Rollover: JS: up to 20 unused base credits; JS+: up to 40 unused base credits (hard caps) at renewal. Top-ups roll to the next period and then expire at the end of that next period (see Pricing for specifics).

3) Billing, Taxes, and Refunds

• Monthly plans renew every 30 days from the start date until canceled. Taxes may apply.
• Except where required by law, fees are non-refundable. For billing questions or errors, please reach us via the contact form within 14 days.
• Payment processing is handled by our provider (e.g., Stripe). We do not store full card numbers.

4) Acceptable Use

• No unlawful, harmful, or abusive use; no scraping, automated bulk submissions, or attempts to bypass rate limits.
• One Starter per person/email/card/device. We may use soft limits, CAPTCHAs, and IP/device checks to mitigate abuse.

5) Your Content and Privacy

• You retain ownership of the resume, job descriptions, and other content you provide (“User Content”). You grant us a worldwide, non-exclusive license to process and display User Content to provide the Service.
• We process your data as described in our Privacy Policy.

6) AI Providers and Third-Party Services

We may use third-party providers (e.g., OpenAI, Anthropic, Cloudflare, Stripe, Resend). Model availability and quality may vary. We do not guarantee specific outputs or hiring outcomes. Where third-party terms apply, you agree to comply with them.

7) Intellectual Property

• The Service (software, site design, brand) is owned by Resumaier and its licensors.
• We grant you a limited, non-transferable license to access and use the Service for personal or internal business purposes.

8) Feedback

If you provide feedback or suggestions, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use it without restriction or compensation.

9) Disclaimers

THE SERVICE IS PROVIDED “AS IS”. WE DISCLAIM ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee interviews, offers, or hiring outcomes.

10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESUMAIER AND ITS SUPPLIERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO RESUMAIER FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.

11) Indemnification

You will indemnify and hold harmless Resumaier from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

12) Termination

You may stop using the Service at any time. We may suspend or terminate access for any breach of these Terms or to protect the Service or other users. Upon termination, your right to use the Service ceases immediately.

13) Changes to the Service or Terms

We may modify the Service or these Terms. If changes are material, we will provide notice (e.g., by posting on the site). Your continued use after changes take effect constitutes acceptance.

14) Export and Sanctions

You may not use the Service if you are subject to U.S. sanctions or restrictions, or for prohibited end uses.

15) Governing Law

These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict of law principles.
